Terms of Service

These are the terms for using StreamDay, a service operated by Virtue Apps (a sole proprietorship registered in Ontario, Canada).

By using StreamDay, you agree to these terms. If you do not agree, do not use the service.

StreamDay is in beta

StreamDay is actively under development. While we work to make the product as reliable as we can, you should know:

  • Some features may not work perfectly, and bugs are expected
  • We cannot guarantee that data you enter is fully protected, and in rare cases data loss is possible as we work through unknown issues
  • We rely on our users to help us spot bugs and report them through our contact form

By using StreamDay during the beta, you acknowledge these limitations and accept that the service is provided on this basis. We will remove this notice when we exit beta. Aside from this paragraph, the rest of these terms apply at all times.

What StreamDay is

StreamDay is a scheduling tool for streamers. You can:

  • Build your personal stream schedule, either by entering streams manually or by connecting your Twitch or YouTube account so we can import your scheduled streams automatically
  • Mark each scheduled stream with the platforms you'll be live on (YouTube, Twitch, Kick) so your audience can pick where to watch
  • Coordinate multi-streamer collab events and shared community events
  • Publish your schedule or event as a public page anyone with the link can view

StreamDay is a tool, not an event organiser. We do not host streams. We do not guarantee that any streamer will actually appear at the time listed. We do not verify the identity of streamers listed in events. Kick does not currently offer an API, so any Kick references are manually entered.

Who can use it

To use StreamDay you need:

  • A Discord account in good standing
  • To meet Discord's minimum age requirement in your country (13 in most places, 16 in some EU countries)
  • The legal capacity to enter into these terms

Because Discord is the only sign-in method we offer, and Discord enforces its own age and account requirements, you must comply with Discord's terms in order to use ours.

Your account

  • You are responsible for keeping your Discord account secure. If someone gets into your Discord, they can get into your StreamDay.
  • You are responsible for everything that happens under your account.
  • An account is per user. Subscriptions are tied to the user account (your Discord login), not to individual events or organisational accounts.
  • If you are the owner of a shared event or organisational account, you can add admins to help you run it, but you (the owner) are responsible for maintaining the active subscription required to keep its public links live.
  • You can delete your account at any time from your settings. Deletion is immediate and permanent.

Connecting Twitch and YouTube

If you choose to connect a Twitch or YouTube account, you authorize us to access and store data about your scheduled streams on that platform, and to keep your StreamDay schedule in sync with that data in the background.

You can disconnect a connected account at any time from your settings. Disconnecting deletes the tokens we hold and stops the background sync.

When you connect these accounts, you are also bound by the terms of the platform you're connecting:

  • Twitch's terms apply to your Twitch account and the data we receive from it
  • YouTube's terms (including the YouTube Terms of Service and Google's policies) apply to your YouTube account and the data we receive from it

You are responsible for complying with those platforms' terms. If a platform changes its API, removes features, or rate limits our access, this may affect StreamDay's import functionality, and we have no control over those changes.

Acceptable use

Do not:

  • Post illegal content of any kind
  • Impersonate other streamers, brands, or people
  • Use the service to harass, abuse, or threaten anyone
  • Scrape the service or use bots, scripts, or automated tools to access it (except where explicitly permitted by us in writing)
  • Try to break, overload, or exploit the service or its infrastructure
  • Reverse engineer or copy the service to build a competing product
  • Use the service to distribute malware, phishing pages, or scams
  • Add custom links to your public page that point to malware, phishing pages, scams, illegal content, or any other content that violates these terms

We may suspend or terminate any account that violates these rules, without notice and without refund.

Your content

When you create events, upload avatars, or enter streamer information, that content remains yours. You give us a limited licence to host, store, display, and distribute that content as needed to run the service, including showing it on public event pages and sharing it through public links you generate.

You are responsible for:

  • Having the rights to anything you upload or post (including images you use as link icons)
  • Having permission to list other streamers and their channels in your events
  • The accuracy of event information
  • The destination, content, and legality of any custom links you add to your public page

You can add custom links to your published page, pointing to other websites or services you want to promote (other channels, communities, merch, etc). The destinations of these links are entirely your choice. We do not endorse, verify, or take responsibility for any third-party site you link to. You must not use these links to direct visitors to illegal content, malware, phishing, scams, or any other content prohibited by these terms.

We may remove content that violates these terms or that we receive a valid legal notice about.

Public event pages

When you publish a stream schedule or event, the page becomes accessible to anyone with the share link, and is also indexed by search engines like Google. This means your page may appear in search results. Treat anything you publish as fully public information. Do not put private data into titles, descriptions, or anywhere else that gets published.

Payments and subscriptions

Creating an account, connecting your platforms, planning events, and building your stream schedule are all free. You only need a subscription when you want to publish: that is, generate a public link to your schedule or to a shared event so other people can see it.

Every new account gets a 30-day free trial of the full service. See "Your free trial" below for how it works.

Plans

  • Monthly: $1.99 USD per month
  • Annual: $19.99 USD per year (effectively two months free compared to monthly)

Prices are in US dollars. Paddle, our Merchant of Record, will calculate and apply the appropriate regional sales tax (VAT, GST, HST, or local sales taxes) at checkout based on the location you declare.

Your free trial

Every new account is eligible for a one-time 30-day free trial that gives you the full service, including publishing.

How it works:

  • You choose your plan (monthly or annual) and provide your payment details up front when you start the trial. Paddle, our Merchant of Record, collects and holds these details. We never see your full card number.
  • You are not charged during the 30-day trial.
  • If you do not cancel before the trial ends, your chosen plan begins automatically and you are charged the price for that plan.
  • Paddle sends you a reminder email before your trial ends and the first charge is made. This reminder is sent by Paddle as part of their billing compliance, and includes a link to update your payment method or cancel. We rely on Paddle to send it; we do not control its exact timing or content.

Cancelling during the trial:

  • You can cancel at any time during the trial from your settings or through Paddle.
  • If you cancel during the trial, your access (including any published links) ends immediately, because no paid period has started and nothing has been charged. We will warn you of this before your cancellation takes effect.
  • This is different from cancelling a paid subscription, where you keep access until the end of the period you have already paid for.

Changing your plan during the trial:

  • You can upgrade from monthly to annual during the trial if you want to lock in the annual rate.
  • To switch from annual to monthly, you would need to cancel and resubscribe. Note that cancelling ends your trial immediately and does not restart it (see below).

The trial is one-time per account:

  • The 30-day free trial is available only once per account, for your first subscription.
  • You cannot start a trial, cancel before being charged, and then resubscribe to get another free trial.
  • If you cancel and later resubscribe, you resubscribe as a paying customer with no further free trial.

What a subscription does

While you have an active subscription:

  • You can publish your personal stream schedule with a public link
  • You can publish shared event pages with public links
  • Existing published links remain live and continue to update with new data

If your subscription ends (whether by cancellation or by payment failure):

  • Existing public links you've shared will stop displaying your data
  • Visitors to those URLs will see an empty state explaining that the page is no longer active
  • This applies equally to personal stream schedule links and to shared event links
  • Your underlying data is not deleted — you can resubscribe at any time and your links become live again

Changing or cancelling your subscription

This section covers cancelling a paid subscription. For cancelling during your free trial, see "Your free trial" above.

You can cancel your paid subscription at any time from your settings or through Paddle. When you cancel:

  • You keep access to publishing for the rest of the period you have already paid for
  • After that period ends, your public links stop displaying data as described above
  • No partial refunds are given for the unused portion of the period

You can upgrade from monthly to annual at any time. To downgrade from annual to monthly, we recommend cancelling your annual subscription, setting a reminder for when it expires, and starting a monthly subscription at that point. The product does not currently support a direct annual-to-monthly downgrade.

Failed payments

If a subscription payment fails (for example, your card has expired or has been cancelled), Paddle will attempt to notify you using the details they hold. We will also show you a notice in the app the next time you log in.

You are responsible for keeping your payment details current. If your card has expired or been cancelled, you can update your details from the subscriptions page in your account settings by clicking "update payment details."

If payment continues to fail after the retry period set by Paddle, your subscription will lapse and your public links will stop displaying as described above.

Payments are handled by Paddle (Merchant of Record)

Paddle is our Merchant of Record. This means Paddle, not us, sells the subscription to you. Paddle is responsible for:

  • Collecting payment
  • Applying applicable taxes for your region
  • Issuing receipts
  • Holding your payment information and complying with payment regulations in your country
  • Notifying you about subscription events such as renewals, failed payments, and price changes

Disputes

If you want to dispute a subscription charge or raise an issue about billing, contact us. We will work with you and, where needed, pass the matter on to Paddle.

Refunds

We do not offer refunds, except where required by law in your country. If you are entitled to a refund under consumer protection law in your jurisdiction, contact us and we will handle it through Paddle.

This means:

  • No refunds for partially used subscription periods (monthly or annual)
  • No refunds for time after cancellation
  • No money-back guarantee period
  • No refunds for a charge that occurs because you did not cancel before your free trial ended. Paddle sends you a reminder before the trial converts, and you can cancel any time during the trial to avoid being charged.

Price changes

We may change pricing. Existing subscriptions continue at the price you signed up at until the next renewal. We will notify you in the app the next time you visit, at least 30 days before any renewal at a new price, so you can decide whether to cancel before the new price applies.

Intellectual property

StreamDay, the StreamDay name, logo, and all related branding belong to Virtue Apps. The code, design, and infrastructure of the service belong to Virtue Apps.

You do not get any rights to our brand or our code by using the service. You can refer to StreamDay by name to describe that you use it.

You retain ownership of your content. We only get the licence described in the "Your content" section above, and only for as long as needed to run the service or as you have made your content public.

Service availability

The service is provided "as is" and "as available." We do not guarantee:

  • That the service will be available at any particular time
  • That the service will be free of bugs or errors
  • That data will not be lost due to technical issues, our or our providers' fault, or events outside our control
  • That share links or features will continue to work indefinitely
  • That the Twitch or YouTube integrations will work uninterrupted (those platforms control their own APIs and may change them, rate limit access, or remove features without notice)

During the beta period in particular, we cannot guarantee that data you enter into the system is fully protected. In rare cases, unknown issues may cause data loss while we are still working to resolve them. By using the beta, you acknowledge this risk.

We try our best, but we are a small operation. Do not rely on StreamDay as the only record of your event information. Keep your own copies of anything important.

Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages.
  • We are not liable for lost profits, lost data, lost goodwill, or business interruption.
  • Our total liability to you for any claim related to the service is capped at the greater of (a) the amount you paid us in the 12 months before the claim, or (b) CAD $100.

This limit applies regardless of the legal theory of the claim (contract, tort, statute, or otherwise).

Some jurisdictions do not allow certain limitations on liability. If you live in one, the limitations above apply to the maximum extent the law allows, and may not apply to you in full.

Indemnification

You agree to indemnify and hold harmless Virtue Apps and its operator(s) from any claims, damages, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the service
  • Your content
  • Your violation of these terms
  • Your violation of someone else's rights, including intellectual property and privacy rights

Suspension and termination

We may suspend or terminate your account if:

  • You violate these terms
  • You use the service in a way that creates legal risk for us
  • You fail to pay for a paid subscription
  • We are required to by law

You may delete your account at any time. Deletion is immediate and permanent.

If we terminate your account for cause, you are not entitled to a refund of any prepaid amounts.

Changes to these terms

We may update these terms. When we do, we will update the "Last updated" date at the top.

For minor changes (typos, clarifications), the updated terms take effect when posted. For material changes (those that meaningfully affect your rights or obligations), we will notify you within the app the next time you visit. If you do not agree with the change, you can delete your account at that time.

If you keep using the service after changes take effect, you accept the updated terms. If you do not agree with the changes, stop using the service and delete your account before they take effect.

Governing law and disputes

These terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada that apply there. Any dispute arising out of these terms or your use of the service must be brought in the courts of Ontario, and you agree to the exclusive jurisdiction of those courts.

If you live somewhere with mandatory consumer protection law, nothing in these terms removes rights you have under that law.

Other things

  • Severability: if any part of these terms is found unenforceable, the rest still applies.
  • No waiver: if we do not enforce a part of these terms once, that does not mean we have given up the right to enforce it later.
  • Assignment: you cannot transfer your rights under these terms. We can transfer ours, for example if the business is sold.
  • Entire agreement: these terms, together with the Privacy Policy, are the full agreement between you and us about the service.
